Terms & Conditions: 

 

1. Acceptance of Terms:

• By accessing our website or making any payment, the Client irrevocably agrees to all Terms & Conditions of Shree Kalika Design Studio (SKDS).

• Payment confirms intent to hire services and forms a legally binding agreement.

• Continued use of services constitutes acceptance of any updated terms without prior notice.

2. Scope of Services:

• SKDS provides high quality goods and services including branding, design, marketing, development, and digital solutions.

• Deliverables will be provided as per agreed scope, timeline and format.

• Pricing reflects industry standards, expertise and resource allocation.

3. Payment Terms (Strict & Binding):

• 100% advance payment is mandatory for all services.

• Payment methods include Razorpay, UPI, QR Code, etc.

• In case of duplicate payments, failed transactions, or technical issues, resolution will be processed after verification as per banking timelines.

• Non-Refund & No Cancellation Policy
  Once payment is made:
  ❌ No cancellation
  ❌ No refund
  ❌ No chargeback
  Applies under all circumstances including:
  ❌ Change of mind
  ❌ Dissatisfaction
  ❌ Delay due to client
  ❌ Incorrect inputs

• If client cancels, delays or withdraws → Full amount forfeited.

4. Client Responsibilities:

• Client must provide: Accurate & lawful information, Timely approvals & materials, Proper cooperation.
  SKDS is not liable for: Errors due to wrong input, Delays caused by client, Loss arising from non-cooperation.

 

5. Project Execution & Deliverables:

• Work begins only after full payment.

• Deliverables shared in agreed formats.

• Revisions allowed only within defined scope.

• Extra revisions → Additional charges applicable.

6. Pricing & Offers Policy:

• Prices may change without prior notice.

• Quoted price valid for 30 days only (if unpaid).

• Prices from third-party websites not accepted.

• Offers may be modified or withdrawn anytime.

7. Intellectual Property Rights:

• Ownership remains with SKDS until full payment clearance.

• After full payment: Client gets usage rights (unless stated otherwise).

• SKDS retains right to: Showcase work in portfolio

• Unauthorized use, resale or distribution → Strictly prohibited.

8. Service Suspension / Termination:

• SKDS reserves the right to suspend or terminate services without refund if:
  Provides false information, Misuses services, Client delays payments, Behaves abusively, Fails to cooperate.

• Decision of SKDS is final & binding.

9. Maintenance & Payment Default:

• Non-payment by due date → Immediate service suspension.

• No prior notice required.

• Client responsible to ensure timely payments.

10. Misconduct Clause:

• By Any misbehavior with staff leads to: Immediate termination.

• No refund.

• Decision by SKDS management is final and non-negotiable.
   

11. Refund Policy (Strict Interpretation):

• Refunds are generally not applicable

• Exceptions (at sole discretion of SKDS):
  Before work starts → possible full refund
  After initial draft → partial refund (case-by-case)

• No refund after:
  Approval & Final delivery

 

12. Limitation of Liability:

• SKDS is not liable for:
  Indirect or consequential losses
  Business loss or downtime
  Data loss
  Technical failures
  External factors (natural events, government actions)

• Maximum liability limited to amount paid by client.

13. Legal Compliance & Jurisdiction:

• Governed by Indian Laws.

• Jurisdiction limited to Mumbai High Courts (Maharashtra).

• Client agrees to exclusive jurisdiction.

14. User Conduct (Website Usage):​

• Client agrees NOT to:
  Post illegal / abusive / defamatory content.
  Violate intellectual property.
  Use unethical or automated access methods.
  Disrupt website or services.

• Violation → Legal action + termination.

15. Data & Privacy Policy:

• Client data collected for: Service execution, Communication, Analysis.

• SKDS ensures: Data protection via secure systems, No selling of personal data.

• Communication may include: Email / SMS / Calls (opt-out available).

16. Third Party Sharing: 

• Data shared only: With consent and with trusted partners (in aggregate form).

17. Communication Policy:

• Clients may receive: Updates and Promotions.

• Option to unsubscribe anytime.
   

18. Security Disclaimer:

• SKDS uses industry-standard protection.

• However, no system is 100% secure.

• Client shares data at own risk.

19. Copyright & Trademark:

• All content belongs to SKDS.

• Unauthorized use → Legal action.

20. Termination of Access:

• SKDS may terminate access: Without notice or for any violation.

• All rights immediately cease upon termination.

 

21. Indemnification:

• Client agrees to: Indemnify SKDS from losses, damages, claims.

• Includes: Legal costs and Third party claims.

22. Force Majeure:

• SKDS not responsible for delays due to: 
  Natural disasters.
  Government restrictions.
  Technical failures.
