This legally binding Terms & Conditions Agreement (“Agreement”) is entered into between:

Shree Kalika Design Studio / Shree Kalika Astro, including its owners, affiliates, employees, astrologers, consultants, representatives, applications, websites, payment gateways and service providers (hereinafter referred to as “Company”, “We”, “Us”, or “Our”)

AND

Any individual, customer, buyer, visitor, subscriber, user, member, or service recipient (hereinafter referred to as “User”, “Customer”, “Buyer”, “You”, or “Your”).

✅ By accessing, browsing, registering, communicating, making payment, booking consultations, or using any service through our Website, WhatsApp, Social Media, Mobile Applications or Payment Gateway (including Razorpay), you acknowledge that:

• You have read this Agreement

• You understand this Agreement

• You voluntarily accept this Agreement

• You legally agree to be bound by all terms mentioned herein

❌ If you do not agree with any part of these Terms, you must immediately discontinue use of the platform and must not proceed with payment or services.

 

2. COMPLIANCE WITH INDIAN LAWS

Shree Kalika Design Studio and Shree Kalika Astro strictly comply with the laws of the Republic of India.

We do NOT promote, encourage, support, advertise or perform:

7. USER RESPONSIBILITIES & DATA ACCURACY

You are solely responsible for:

✅ Reviewing all submitted information before payment

❌ No refunds, replacements, or re-consultations shall be provided for:

• Incorrect birth details submitted by user

• Wrong phone number/email

• Missed consultations due to user unavailability

• Late correction requests

• Incorrect user assumptions or expectations

8. AGE ELIGIBILITY

🔞 You must be at least 18 years old and legally competent under the Indian Contract Act, 1872.

Use of services by minors is prohibited unless supervised or requested by a lawful parent/legal guardian.

9. Rudraksh Product

Every Original Nepali Rudraksha is a unique natural product. Variations in size, shape, colour, texture, weight, surface appearance and natural markings are inherent characteristics and shall not be considered defects. Product images are for illustrative purposes only, and the actual product may vary slightly. Prices are determined based on the Rudraksha's Mukhi, size, quality, rarity, certification and availability and are subject to change until an order is confirmed. Products are sourced from trusted and verified suppliers and certain Rudraksha may be procured against confirmed customer orders after quality verification. Where applicable, certification and/or X-ray reports are provided by the respective testing authority or supplier. The traditional spiritual and astrological benefits associated with Rudraksha are based on ancient scriptures and beliefs and should not be interpreted as guarantees of specific spiritual, medical, financial, legal or personal outcomes. Individual experiences may vary.

10. PAYMENT, GATEWAY & TRANSACTION TERMS

💳 Payments are securely processed through third-party payment gateways including Razorpay, UPI, Cards, Net Banking, Wallets, or international payment methods.

The Company shall not be liable for:

• Banking server issues

• Gateway downtime

• Failed transactions

• Technical interruptions

• Payment delays beyond our control

In case of:

• Payment timeout

• Session failure

• Server error

• Duplicate payment

You must:

✅ Verify your bank statement before retrying payment
✅ Contact support immediately with transaction proof

If duplicate payment for the same service is verified, excess amount may be refunded after verification as per banking and payment gateway timelines.

11. NO REFUND POLICY (STRICT)

⚠️ ALL PAYMENTS ARE FINAL.

❌ No refund shall be issued for:

• Dissatisfaction with predictions

• Difference in beliefs/opinions

• Incorrect user information

• Delayed user response

• Completed consultations

• Delivered reports

• Digital products/services already accessed

Refund requests may be considered ONLY in exceptional technical cases solely at the Company’s discretion.

By requesting refunds or raising disputes, you authorize the Company to access call/chat/order records for legal and audit purposes.

12. PROHIBITED ACTIVITIES

• Sharing abusive, hateful, obscene, sexual or violent content

• Attempting fraud, impersonation, hacking or manipulation

• Uploading malicious software or viruses

• Requesting illegal activities

• Defaming the Company publicly without lawful basis

Violation may result in:

❌ Permanent ban
❌ Cancellation of services without refund
❌ Legal action under applicable Indian laws

Unauthorized copying, reproduction, redistribution, resale, recording, publication or commercial use is strictly prohibited and may invite legal action.

14. LIMITATION OF LIABILITY

To the maximum extent permitted under applicable law:

⚠️ The Company’s total liability shall never exceed the amount actually paid by the user for the specific service.

The Company shall NOT be liable for:

15. ACCOUNT TERMINATION & SERVICE SUSPENSION

We reserve the absolute right to:

• Terms are violated

• Abuse occurs

• Fraud/risk is detected

• Legal concerns arise

🌐 External websites, ads, payment providers or third party links are used at your own discretion and risk.

We are not responsible for third party content, policies, availability, or services.

17. GOVERNING LAW & JURISDICTION

⚖️ This Agreement shall be governed by the laws of India.

Any dispute shall be:

• Subject to arbitration in Mumbai, Maharashtra, India

• Governed under the Arbitration & Conciliation Act, 1996

• Conducted in English language

Mumbai Courts shall have exclusive jurisdiction.

 

18. MODIFICATIONS & UPDATES

We reserve the right to modify, update or change these Terms at any time without prior notice.

Continued use of services constitutes automatic acceptance of revised Terms & Conditions.

19. ENTIRE AGREEMENT

This Agreement constitutes the complete understanding between the User and the Company and supersedes all previous communications, representations, or understandings.
